Chapter 1 General Pro visions Article 1 Purpose ㄧ This membership articles shall purport to determine conditions and procedures designed to use X-Ray information service ("service") provided by Amfis co.,Ltd .("the company"). Article 2 Definition of Terminology The definition of terminology used in this membership articles shall be as follows. ㄧ Operator : The person that the company appoints to manage and smoothly operate the overall service. ㄨ Termination : Meaning the company or members terminate the membership contract. ㄩ Member, user: The person (persons) who is (are) granted ID(s) after concluding the membership contract with the company (free/Amfis members). Company: Amfis, the service provider. Fees : The charges that is imposed in return for using service (corporation registration/advertising, consulting and others) from the time that the membership contract is concluded until the time that it is terminated. Information fees (Additional service) : Fees that are charged when amfis members use consulting service of the additional information service and other services. Service : Provision of X-Ray-related information. Chapter 2 Enforcement and Change of Membership Articles ㄧ This membership articles shall take effect by announcing it to customers through the company's service screen. ㄨ The company shall post the contents of the Membership Articles on the service screen, and when there is change in it, the company shall notify it to members through the bulletin. ㄩ The company may, as is deemed necessary, amend the Membership Articles, and such amendment shall take effect as the way in the article 1. Chapter 3 Service Contract Article 3 Service Contract ㄧ Applicants shall apply to register with the membership using the company-prescribed form, and individual members basically can use service for free (Certain services) services. ㄨ When applying to register to use service, applicants shall read this Membership Articles and press "agree" button, then this will be regarded as agreed. ㄩ Membership contract shall take effect after an applicant agrees upon it and then the company consents to it. Members can, through individual information management, have access to and use and revise individual information at any time. When there is change in items entered, members shall revise it online, and liabilities arising from no revision shall rest with members. Article 4 Registration of Advertisements ㄧ Members may apply to register advertisements using the company-prescribed forms, and after the application made, members notify it to the operator, pay the running fees, and then can immediately have their advertisements carried. Article 5 Termination of Service Contract ㄧ When a member terminates service contract, he or she shall apply to the company to terminate it online or by phone. ㄨ When a member does the following act or acts, the company may, without prior notice, terminate service contract, or set a certain period of time to suspend the use of service, however provided that in the event of the termination of service contract, the company shall notify it to such a member, and grant him an opportunity to explain himself for that. A. A member uses other person's ID or password; B. A member intentionally hampers the service operation; C. The name registered turns out to be not a real name; D. The same user registers again using other ID. E. A member disseminates intentionally contents impeding the public order and established social morals and good manners. F. A member, with the purpose of obstructing the national or social interests, plans to use service or puts it to practice. G. A member does acts that hurt others' honor and offer disadvantages. H. With the purpose of disrupting the safe operation of service, a member transmits a large quantity of information or advertising-prone information. I. A member infringes the intellectual property rights of the company, other members, or a third party (parties). J. A member uses wrongly the other person's private information, user ID and password. K. A member copies or distributes or commercially uses the information that he gains using the company's service information. L. A member posts obscene materials on the bulletin, or informs pornography sites. M. A member violates his obligations under the service contract. Article 6 Means of Settlement ㄘ To settle Banner service fees, members may use remittance method with no use of a bankbook, account-to-account transfer, or other settlement methods approved by the company. Chapter 4 Classification and Time of Service Article 7 Classification of Service ㄧ The service that the company provides to members shall be divided into free service and Amfis member service. ㄨ To use additional services, a member shall register as a gold member using the company-prescribed form. As for the kind and using methods of other additional services, members shall follow what is specified in each service and is separately set at the information. Article 8 Time for Using Service ㄧ Service is available 24 hours a day all the year round, if the company is not hit with technical failure in service provision, and there is no special reason. However, in the event that the service is obstructed due to a surge of facilities repairs and inspection and force majeure, the company may limit the whole or part of the service. ㄨ The company may change and adjust its service running hours partially or as a whole. In this case, it shall notify it in advance to users through information and the bulletin. Chapter 5 Acquisition and Protection of Individuals Information Article 9 Protection of Individuals' Information ㄧ The company shall, in accordance with the information net promotion-related acts and regulations, protect individuals' information as received when applications made, additionally received later on, and created while using service. ㄨ The staff in charge of individuals' information shall be a responsible person within the company, and his contact is amfis@amfis.com at 82-31-319-7360. ㄩ The purpose of gathering and using individuals' information shall be as follows, and an applicant shall agree upon it when registering with Membership. A. Contents related to service provision. B. Contents related to service members management. C. Contents related to creating marketing information needed by the company to operate the site. The company shall not do anything that goes against the foregoing purpose, and shall not collect or use individuals information without members' consent. The company shall not provide individuals' information to a third party (parties) without members' consent. However, under following circumstances, the company may, without consent from members, provide members' individual information to a third party (parties). A. In the event that laws dictate so, B. In the event that the company provides individuals' information for the purpose of statistics formulation and academic studies the way they cannot be individually distinguished. A member can access his individual information anytime, and correct errors. He can in principle access and revise his individual information the same way he applies to register. Details shall follow what is set in the announcement and information. A member can, by terminating the contract any time, not withdraw his agreement upon individual information being gathered and used, and separate agreement upon the same used for other purpose and provided to a third party (parties). (See the article 3 of this Membership Articles). Chapter 6 Obligations of the Company and Users Article 10 Obligation of the Company ㄧ The company shall, in accordance with what is set in this Membership Articles, have obligations to provide to users sustained and stabilized service. ㄨ The company shall, without his (their) consent, not divulge or provide to a third party (parties) users' information that it knows in connection with service provision. (Exception : Specified is under chapter 5 Protection of Individuals' Information.). Article 11 Obligations of Users ㄧ Members shall observe relevant laws and regulations, provisions under this Membership Articles, information and instructions, and what is informed by the company, and shall not do acts that hamper the work of the company. ㄨ Members shall, without consent from the company, not use and do any profit-making acts. ㄩ Members shall, without prior consent from the company, neither copy/reproduce/change/ translate/publish/broadcast/otherwise use the information obtained through using the service, nor provide the same to other persons. Members shall, if there is change in entries in the membership application form, notify it to the company through service. (See article 3) In connection with service use, members shall not do acts or act under article 5. Members may, when violating ㄨ and ㄩ provisions above with no prior consultations with the company, take civil and criminal responsibilities. Chapter 7 Immunity and Treatment of Complaints Article 12 Immunity Under following circumstances, the company shall not be liable in providing its service. A. The company shall be indemnified from profits and losses incurred or expected to be so through information or materials obtained by users through service. B. The company shall be indemnified from contents of materials posted or transmitted by users. C. This Membership Articles shall limit its application to users, and the company shall be indemnified from any compensation and claims received from a third party (parties). D. Even if any damage occurs to members in connection with free service, the company shall, except such damage is a gross negligence caused by the company, be indemnified from it. E. When members gather, form, and manage their own coteries groups, if problems arise from violations by such group services users of laws and regulations as well as banned acts, they shall be liable for them and the company shall be indemnified from them. Article 13 Governing Court ㄧ When disputes arise from service fees, etc., if lawsuits are lodged, the court located at the headquarters of the company shall be the governing court. Article 14 Treatment of Complaints ㄧ If the company deems fair and just opinions and complaints posed by members, it shall, at an early date, reflect them in the provision of service, and notify them through information and the bulletin. Chapter 8 Posted Materials and Contents Article 15 Deletion of Posted Materials or Contents ㄧ When posted materials or contents violates above article 5, the company shall arbitrarily delete them at its discretion. Article 16 Rights and Obligations in relation to Posted Materials ㄧ All responsibilities in relation to posted materials shall rest with the member who had posted them.
